1. What AvailableMassages Does

AvailableMassages is an appointment discovery service designed to help users find massage appointments and related information.

The Service may display information such as:

• appointment dates and times;
• appointment durations;
• practitioner or clinic names;
• locations;
• services;
• prices, where available;
• booking availability;
• booking links;
• business contact information; and
• other information that may help users locate an appointment.

Information displayed through the Service may be provided, submitted, licensed, compiled, generated, or otherwise made available to us from a variety of sources.

AvailableMassages is not itself a massage clinic, healthcare provider, booking system, insurer, or payment processor for massage appointments unless we expressly state otherwise.

2. Appointments Are Booked With Third Parties

When you choose to book an appointment, you may be redirected to a clinic, practitioner, scheduling provider, or other third-party website.

The appointment is ultimately booked with that third party, not with AvailableMassages.

AvailableMassages is not a party to the relationship or agreement between you and any clinic, practitioner, or booking provider.

The applicable clinic or practitioner is responsible for matters including:

• confirming the appointment;
• providing the treatment;
• collecting payment;
• cancellation and no-show policies;
• refunds;
• direct billing;
• insurance eligibility;
• receipts;
• treatment records; and
• any other terms relating to the appointment.

You should review the clinic's own terms and policies before completing a booking.

3. Appointment and Listing Accuracy

We work to make AvailableMassages useful and current, but appointment availability can change quickly.

We do not guarantee that any appointment displayed on AvailableMassages will still be available when you attempt to book it.

We also do not guarantee that information displayed through the Service is complete, accurate, current, or free from errors.

Information such as appointment times, prices, treatment types, practitioner availability, direct-billing options, locations, and other details should be confirmed with the clinic or practitioner before relying on them.

The clinic's or practitioner's own booking system should be considered the final source for whether an appointment can actually be booked.

4. Practitioners and Clinics

The appearance of a practitioner, clinic, business, service, or appointment on AvailableMassages does not constitute an endorsement, recommendation, certification, or guarantee by AvailableMassages.

Unless expressly stated otherwise, we do not independently verify every practitioner's:

• credentials;
• professional association membership;
• qualifications;
• licensing or registration status;
• insurance eligibility;
• experience;
• treatment methods; or
• suitability for a particular person.

You are responsible for deciding whether a practitioner or service is appropriate for you.

Businesses and practitioners may contact us to request that information be corrected, updated, or removed.

5. Not Medical Advice

AvailableMassages is an appointment discovery service.

Information provided through the Service is for general informational and appointment-discovery purposes only and is not medical advice, diagnosis, treatment advice, or a recommendation to obtain any particular healthcare service.

Questions about your health or whether massage therapy is appropriate for you should be directed to an appropriately qualified healthcare professional.

6. Third-Party Websites

AvailableMassages may contain links to websites and services operated by third parties.

We do not control those third parties and are not responsible for their:

• availability;
• content;
• accuracy;
• security;
• booking processes;
• privacy practices;
• payment systems; or
• terms and conditions.

Following a third-party link is at your own discretion and risk.

7. Business Listings

Clinics, practitioners, and other businesses may be listed on AvailableMassages.

Where business-management, subscription, promotional, or listing features are offered, a person using those features represents that they have authority to act for the applicable business.

Businesses are responsible for ensuring information they submit to AvailableMassages is accurate and that they have the right to provide any names, logos, photographs, descriptions, availability information, or other materials they submit.

By submitting content to AvailableMassages, you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display, distribute, and use that content as reasonably necessary to operate, promote, and improve the Service.

If paid business features are offered, any pricing and additional payment terms presented at purchase form part of these Terms.

Payment for a listing, subscription, promotion, or other feature does not guarantee any particular number of impressions, website visits, leads, bookings, customers, or revenue.

8. Corrections and Removal Requests

We want information on AvailableMassages to be useful and accurate.

If you believe a business, practitioner, appointment, or other listing contains incorrect information, or you are an authorized representative requesting a correction or removal, please contact us.

We may request information reasonably necessary to verify your identity or your authority to act for a business before making certain changes.

We reserve the right to determine how corrections, removals, duplicates, disputes, or similar listing issues are handled.

9. Acceptable Use

You may use AvailableMassages for lawful, personal, and legitimate business purposes consistent with the purpose of the Service.

You may not:

• interfere with or disrupt the Service;
• attempt to gain unauthorized access to our systems;
• circumvent security or technical restrictions;
• introduce malware or harmful code;
• impersonate another person or business;
• submit knowingly false or misleading information;
• use the Service in a manner that violates applicable law;
• systematically harvest or extract information from the Service for a competing or commercial database without our permission;
• reproduce or mirror substantial portions of the Service;

The AvailableMassages name, branding, site design, software, interfaces, original written content, graphics, organization, and presentation of the Service are owned by or licensed to AvailableMassages and may be protected by intellectual property laws.

These Terms do not transfer ownership of those materials to you.

Certain factual information displayed through the Service may originate with or relate to third parties. Nothing in these Terms is intended to claim ownership over information or intellectual property that belongs to someone else.

11. Service Changes and Availability

We may add, remove, modify, suspend, or discontinue any part of AvailableMassages at any time.

We do not guarantee that:

• the Service will always be available;
• every clinic or practitioner will be included;
• every available appointment will be displayed;
• search results will be complete;
• information will refresh at any particular interval; or
• a particular feature will continue to be offered.

12. Disclaimer of Warranties

To the fullest extent permitted by applicable law, AvailableMassages is provided on an “as is” and “as available” basis.

We make no warranties or representations, express or implied, regarding the Service, including warranties concerning accuracy, availability, reliability, merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable consumer protection laws.

13. Limitation of Liability

To the fullest extent permitted by law, AvailableMassages and its owners, operators, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or similar damages arising from or related to your use of the Service.

This includes losses arising from:

• inaccurate or outdated appointment information;
• an appointment no longer being available;
• services provided or not provided by a practitioner;
• booking or cancellation disputes;
• payment or refund issues;
• reliance on information displayed through the Service;
• third-party websites or booking systems; or
• interruption or unavailability of AvailableMassages.

Where liability cannot legally be excluded, it will be limited to the maximum extent permitted by applicable law.

14. Indemnification

To the extent permitted by law, businesses or users who submit content, manage listings, or use the Service commercially agree to indemnify and hold AvailableMassages harmless from claims, losses, liabilities, and reasonable expenses arising from their submitted content, violation of these Terms, violation of applicable law, or infringement of another person's rights.

15. Privacy

Your use of AvailableMassages is also subject to our Privacy Policy.

When you leave AvailableMassages for another website or booking platform, that third party's privacy practices apply to information you provide there.

16. Changes to These Terms

We may update these Terms as AvailableMassages evolves.

The “Last updated” date at the top of this page identifies the latest version.

Your continued use of the Service after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.

17. Governing Law

These Terms and any dispute relating to AvailableMassages are governed by the laws of the Province of Manitoba and the applicable federal laws of Canada, without regard to conflict-of-law rules.

Subject to applicable consumer protection laws, disputes relating to these Terms or the Service will be brought before the courts located in Manitoba, Canada.

18. Severability
